1. Warranty
This Warranty Policy sets out the commercial warranty and support terms applicable to ATUM products.
The ATUM warranty covers the repair or, at the Company's discretion, replacement of parts recognised as defective due to material or workmanship.
The cost of the commercial warranty is included in the purchase price.
This commercial warranty does not affect or restrict any consumer rights, statutory warranty rights or other mandatory rights granted by applicable law.
2. Warranty Period and Activation
The commercial warranty is valid for 24 months.
The warranty is automatically activated based on the purchase date indicated on the applicable invoice.
Any warranty extension beyond the initial 24-month period is subject to the terms, rates and methods applicable at the time of purchase or extension.
3. What the Warranty Covers
Subject to the terms of this Policy and applicable law, the warranty covers material and manufacturing defects recognised by the Company.
Where a valid warranty claim is accepted, the Company may provide repair or replacement of the defective part or product, as applicable.
During service, the Company may use new or equivalent components in terms of performance and reliability.
4. Warranty Exclusions
The commercial warranty expressly excludes:
- normal wear and defects resulting from the normal consumption of parts that are, by their nature, subject to wear and tear;
- consumable products;
- accessories;
- cleaning services;
- maintenance services;
- calibration services;
- transportation costs to and from authorised service centres;
- return of repaired goods, except where mandatory applicable law provides otherwise.
These exclusions do not limit mandatory statutory rights.
5. Circumstances That May Void the Commercial Warranty
The commercial warranty may be forfeited or become void where ATUM or any part of it:
- is used in a manner inconsistent with the Company's instructions or instructions provided by authorised personnel;
- is modified, disassembled or altered, even partially, by unauthorised personnel;
- continues to be used after a defect occurs instead of being immediately stopped;
- has an altered, deleted or removed serial number;
- is damaged by accident, misuse, negligence or incorrect use;
- is damaged by contact with or immersion in liquids;
- is subject to incorrect installation, repair or maintenance performed by parties other than the Company or its authorised service centres;
- is subject to unauthorised modifications;
- is exposed to unsuitable environmental conditions, including extreme temperatures or humidity;
- is exposed to unusual physical or electrical stress;
- is damaged by power surges, outages, lightning, static electricity, fire, force majeure or other external causes;
- is damaged by impact or falls;
- is used by untrained personnel;
- is inadequately maintained or improperly used;
- is used in violation of applicable laws;
- is left unattended; or
- is otherwise affected by circumstances in which the Company cannot be held directly responsible for a material or manufacturing defect.
The exclusions above apply to the commercial warranty to the extent permitted by applicable law.
6. Support Service
Unless otherwise stated, the Company may provide repair services to correct recognised material or manufacturing defects.
The Company will supply parts and labour for warranty repairs, but may require the Buyer to replace components that are designed to be user-replaceable.
During service, new or equivalent components may be used.
A replaced part or product becomes the property of the Company, while the replacement component or product becomes the property of the Buyer, subject to applicable law.
The Company may provide out-of-warranty repairs or services for issues not covered by the warranty, subject to the Buyer's written approval of the estimated costs.
7. Support Options
Depending on the nature of the issue and eligibility, support may be provided through one or more of the following options:
- DIY Parts Replacement Service – where applicable, the Company may send a replacement part with installation instructions and return guidelines. Where return of the replaced part is required, the Buyer may be required to provide credit card details as a guarantee and return the replaced part within two days of receipt. The Company's warranty documentation states that the Buyer bears the cost of DIY service.
- Courier-Based Service – following eligibility confirmation, the Buyer may be instructed to ship ATUM to the Company or an authorised service centre. The repaired or replacement product will then be returned according to the applicable instructions.
- Advance Replacement Service – following confirmation and provision of credit card details where required, the Company may send a replacement product before receiving the defective unit. The replaced ATUM must be returned within five days where this service applies.
- On-Site Repair Service – where applicable, travel, accommodation, technician labour and waiting-time costs are borne by the Buyer and invoiced according to the Company's current rates, because the commercial warranty covers the repair or replacement of recognised defective parts.
- Authorised Service Centre Repair – following confirmation, the Buyer may deliver and collect the defective product at an authorised service centre, bearing applicable costs.
- Online Repair Service – where applicable, the Buyer may attempt to repair ATUM online by connecting it to the network and following instructions provided by the Company's operator.
The Company may modify the support options available to the Buyer as permitted by law.
8. Diagnostic Fee
As permitted by applicable law, the Company may charge a diagnostic fee, including shipping costs, where it determines that:
- no service intervention is required;
- the issue is caused by malfunction or incompatibility of software or data on the product;
- the malfunction is caused by non-Company or unauthorised third-party components;
- the repair requires additional labour or parts not covered by the original estimate and not approved by the Buyer; or
- the repair cannot be performed because a warranty-forfeiture condition applies.
The warranty documentation provides that, in such cases, the product may be returned without repair and the diagnostic fee may not exceed EUR 100.00.
9. Return Authorisation Number (RMA)
All warranty service requests must be agreed with the Company and confirmed in writing, including requests initially made by telephone.
An RMA (Return Authorisation Number) will be issued for an approved return.
The RMA must be clearly visible on the package and shipping documents.
The warranty documentation states that shipments without the required RMA may be refused at delivery and may result in additional costs for the Buyer.
10. Shipping a Product for Warranty Service
ATUM products returned for repair should be shipped according to the Company's instructions.
The warranty documentation requires the use of the original packaging, including internal supports, and states that the original packaging should be preserved for the full warranty period.
The warranty documentation also states that goods travel at the Buyer's risk and recommends insurance against loss or damage.
The Buyer must follow the Company's shipping and packaging instructions.
Any mandatory consumer rights concerning allocation of transport or other costs prevail over the commercial warranty terms.
11. Replacement and Repaired Products
Where a repair or replacement is provided under the warranty, the Company will return the repaired or replacement product according to the applicable support procedure.
Where a replaced component or product becomes the Company's property, the corresponding replacement component or product becomes the Buyer's property, subject to applicable law.
12. Out-of-Warranty Service
The Company may provide repair or support services for issues that are outside the commercial warranty.
Before carrying out chargeable work, the Company may provide an estimate and obtain the Buyer's written approval.
Chargeable services may include labour, parts, shipping, diagnostics or other applicable service costs.
13. Product Use and User Responsibilities
The ATUM User Manual requires the device to be used in accordance with its safety and operating instructions.
In particular, the manual states that misuse, tampering, use of non-original accessories or non-compliance with safety standards may damage the product and may void the warranty.
The manual also instructs users not to disassemble or modify ATUM, not to use a damaged device or charging cable, to avoid water and excessive humidity, to avoid impacts and falls, and to use authorised fragrances formulated for the device.
14. Manufacturer and Distributor Information
The official ATUM documentation states that ATUM has been designed and produced in Italy by Fatromed S.r.l.
The documentation identifies DAK LUXURY SRL as Owner & International Distributor.
